- Understand fully the terms of KONE’s contract with the customer and also the terms of the subcontract with any of KONE’s subcontractors for the respective project.
- Ensure KONE’s enforcement of its contractual rights and compliance with contractual obligations, e.g. by supporting the project team in issuing notices in accordance with the provisions of the contract, submitting and responding to extension of time and other claims under the contract, submitting payment applications, identifying the works falling within or outside KONE’s scope of works, preparing variation claims, resolving disputes and limiting potential liabilities including managing and reporting claims.
- Support the project team in reviewing incoming and outgoing correspondence and advising on matters that have contractual and/or financial implications.
- Support the project team in issuing all relevant contractual notices timely and in accordance with the provisions of the contract throughout the project to secure KONE’s position.
- Support the project team with the variation process to ensure KONE’s position is secured financially and contractually.
- Assist in the selection and appointment of subcontractors to ensure appropriate terms and conditions of appointment and in the management of their performance, including negotiation of any loss and/or expense claims while work is in progress.
- Assist the project team in maintaining accurate contract files for all correspondence and other related contractual documentation.
- Assist in the management and documentation of the snagging and handover process to secure KONE’s liability position.
- Where necessary work with external Quantity Survey practices/consultants and in conjunction with the project manager, review, monitor and agree the Quantity Surveyors/Consultants preparation of KONE’s claim, prior to its submission.
- Work with the project management team and finance throughout the lifetime of the project to ensure compliance with the contract and ensuring that payment and other claims are submitted in the correct format and with the correct timing to secure monies due to KONE as per the contract.
- Safeguarding KONE’s financial interests both with the customer and all subcontractors/suppliers.
- Support the project team in preparation and submission of applications for payment and the final account in accordance with the terms and conditions of the contract. Liaise and negotiate with the customer in respect of same, as required.
- Ensure invoice disputes are resolved with the maximum benefit to the project
- From time to time support with the contractual review of Customer contract terms and conditions also in the Tendering phase and identification of key concerns and liabilities
- identification and removal of non-market standard or otherwise onerous or unacceptable obligations or liabilities and ensuring KONE’s contractual rights are included. Ensuring compliance with the KONE Code of Conduct and Competition Policies, prevention of improper payments (kick-backs, facilitation payments, commissions or the like), and securing customs clearance, handover approvals, tender awards and similar.
- Provide contract management training to Sales, Quantity Surveyors, Project Managers and other personnel managing the Sales & Tendering or Execution Phases of our Customer projects.
- Familiarity with local jurisdiction laws and regulations, industry form construction contracts, including:
- Industry market practice; and thorough understanding of contractual issues, legal risks and liabilities.
- Knowledge of project operations and financial processes, including:
- Financial skills - the ability to understand financial data at contract level and identify appropriate actions indicated by variances to ensure key metrics are achieved.
- Operational analysis – the ability to obtain relevant information on operational issues from multiple sources, think broadly about those issues and recognize trends/possible cause-effect relationships.
- Fluent in project’s required language with good working ability in spoken and written English.
- Fluency in Microsoft Office (especially Excel & PPT) essential. Fluency in Project software such as Primavera/MS project an advantage,
